Website terms.

I am here to build you a website that wins the work and make the whole thing easy. I am also running a business, and like every business owner I need to protect myself, so here are the terms. Plain English, no surprises. They apply to every Jyethetechguy website build, redesign, search visibility check and automation, and by paying to secure your build slot or booking a job you agree to them.

What you are getting

Exactly what is in your quote. The package, page count, features, integrations and ship date are all fixed in writing before you pay. If it is not in the quote, it is not in the project, and I will always tell you before doing anything extra so there are no surprise invoices.

The packages

Core, from $2,495. For startups and small businesses that need a clean, professional website that just works. Custom design and build up to 4 pages, mobile friendly across desktop, laptop, tablet and phone, contact form with spam protection, CMS setup, SEO setup, 30 point search visibility check, speed tested on all devices, domain connected and launched by me, full handover with recorded walkthrough and 14 days post launch support. 2 rounds of revisions at design, 1 at build. 2 to 3 weeks.

Plus, from $4,950. For growing businesses that need more pages, better structure and a smoother user experience. Everything in Core, plus up to 8 pages, advanced CMS with collections that each get their own search friendly page, custom animations and interactions, third party integrations like booking, email and payments, conversion focused page structure, redirects from your old URLs on a redesign, and Google Analytics 4 and Search Console connected. 2 rounds of revisions at design, 1 at build. 3 to 5 weeks.

Pro, from $8,495. For businesses that want a fully custom website built properly from the ground up. Everything in Plus, plus a fully bespoke concept designed from scratch, advanced animations and page transitions, multi-CMS setup with video and motion elements, advanced integrations and custom functionality, two automations built in chosen from the single automation tier (for example enquiry handling or booking reminders, a chat assistant or bundle is quoted separately), performance tuned to pass Core Web Vitals, accessibility fundamentals, priority build and launch timeline, and 30 days post launch support with one check-in. 3 rounds of revisions at design, 1 at build. 6 to 8 weeks, scoped individually.

Search visibility check, from $995. A one off audit and fixes on an existing site, whether I built it or not. Included at no extra cost in every new build and every care plan.

Automations. Single automation from $595, one workflow built and tested on real enquiries. Automation bundle from $1,495, three connected workflows. Website chat assistant from $1,195, trained on your content with clear handover rules. Two automations are included in every Pro build. These are starting points, not a fixed menu, and what we agree is written into your quote.

Your quote confirms which package applies, the exact page count and the fixed price. Inclusions are as published on the websites page on the date you pay.

Tailored plans and discounts

The packages are a starting point, not a cage. Custom scopes, mixed packages, discounts and payment arrangements are all available and we agree them together before you pay. Whatever we agree is written into your quote, and your quote is what applies.

Not included

Copywriting, photography, videography, logo or brand design, ongoing SEO or content marketing, paid ads, email marketing setup, ecommerce beyond what is in your quote, legal pages like your privacy policy, third party subscription costs and maintenance after the support period. Any of these can be added if we agree it in writing first. If you need stock imagery I can source it and the licence cost is quoted first.

Paying

Every price is fixed before work starts. No hourly billing. Most builds are paid 100% upfront, which locks your build date into the calendar, and work does not start until it lands. Sometimes I can make an alternative arrangement, such as 50% to lock in the date and 50% once the site is completed, but that is discussed case by case and agreed in writing before we begin. A standalone search visibility check or automation is paid in full on booking. Everything is paid through Stripe. Prices exclude GST and GST is added where it applies. No card surcharge. I will never ask you to pay outside Stripe.

Your payment and my commitment

Your payment locks in my time and your place in the schedule, and I turn other work away to hold it. Refunds are not available once your build date is within 14 days or work has started. Before that, if you change your mind you get a full refund. If you cancel part way through, you pay for the work done to that point and I hand it over. I also reserve the right to cancel your project and not build it. If I do, I end the agreement in writing and you receive a full refund of everything you have paid, no questions asked.

What I need from you

Your copy, images, logo and brand assets uploaded to our shared Google Drive. I am happy to start building and collect final content later, but your ship date does not start until payment is in and all your content is with me. One person with authority to give feedback and sign things off. Access to any accounts I need, including your domain registrar and Google Business Profile. Replies within 5 business days when I ask for feedback or approval. You are responsible for the accuracy of what you send, including prices, claims and contact details.

Timeline

Your ship date is confirmed before we begin and runs from the day payment and all content are with me. It is a good faith estimate and depends on you sending feedback on time. If your side runs late, the project moves to my next available slot and I will tell you the new ship date straight away. If content is more than 14 days late the ship date moves. If I hear nothing for 30 days the project pauses. You can restart within 90 days at no cost. After that it is treated as cancelled and I invoice for the work done.

Placeholder content

If your content is not ready, I use placeholder text and images to keep things moving. Swapping in your final content is included. Redesigning a page because the final content is a completely different length or shape is a variation.

How the build runs

I design your key pages first so you see the direction before the whole site is built. You give feedback, I make changes, and we keep going until you are happy. Once the design is approved, it is built into a real site with your CMS, forms, animations and integrations wired up and tested. Before anything goes live it passes the 30 point search visibility check. Then your domain is connected, tested and the site goes live.

Revisions

Feedback and changes are handled at the design stage and again at the build stage. Core and Plus include 2 rounds at design and 1 at build. Pro includes 3 and 1. A round is one consolidated set of feedback sent at one time. Revisions are refinements to what has been built: layout, spacing, colour, imagery, copy. Once the design is approved and the build starts, design changes become variations.

Variations and scope changes

If the scope changes once the build is underway, whether that is a change of direction, a new page, a new feature, an extra integration or redesigning something already approved, I can increase the price or send an additional invoice to cover it. But here is the rule: I will always tell you it costs extra and what it costs before I start on it, as a fixed price with any effect on the ship date. Nothing happens until you say yes in writing. I will never do the work first and tell you afterwards, and you will never receive an invoice you have not agreed to.

Approval and launch

When the site is finished I send it to you for review. You have 7 business days to approve it or tell me what does not match the quote. If I do not hear back I send a reminder with another 5 business days, and after that the site is treated as approved and any final invoice is due. The site goes live once it is approved and paid in full.

Domain and going live

Your existing domain is connected to the new site, or I help you set up a new one. On a redesign your old URLs are redirected so you keep your domain, your email and the Google standing you have earned. Nothing gets lost in the move.

The 30 point search visibility check

Six areas, five checks each: structure and content, search and social metadata, images and speed, technical setup, local visibility and proof. It covers page titles and descriptions, URLs, alt text, image compression, Core Web Vitals, Search Console verification, sitemap submission, redirects, Google Business Profile connection, consistent business details, analytics and testing every form and button. You get a short report showing what was wrong, what I fixed and what to watch, and indexing is confirmed with Google about a week after launch. On a standalone check I need access to your site, Search Console and Google Business Profile, and fixes that need a redesign or new pages are quoted separately. It is not an SEO campaign, it does not include keyword strategy, content writing, link building or paid search, and I do not guarantee rankings, traffic or how long results take. Search engines change their rules without notice.

Automations and AI tools

Automations are built inside your site and the tools you already use, and I document each one in plain English at handover. You see it run on real enquiries before it goes live. Every automation runs on your instructions, with a human in the loop wherever it matters, and nothing is sent to a tool you have not approved. If something should stay manual, I will tell you.

A few things to know. Automations depend on third party tools like Zapier, Make, Cal.com, OpenAI, WhatsApp and your CRM. Their subscriptions, usage fees and API costs are yours unless your quote says otherwise, and I am not responsible if one of them changes, breaks or shuts down, though I will tell you and suggest a fix. Chat assistants answer from your own content and can still get things wrong, so you are responsible for checking what they say and for how your customers’ data is handled under your own privacy policy.

Automations are covered for 14 days after handover (30 on Pro) for anything in my work that does not run as agreed. After that, keeping them running and tuned is part of Care Pro, or quoted as needed.

Handover

Your site lives in your own Framer or Shopify account from day one. At launch I hand over any logins I hold for you and walk you through managing the site and how it appears in search, live or by recorded video. From that point the site is yours to run.

Post launch support

For 14 days after launch (30 days on Pro, with one check-in) I fix anything in my own work that does not function as agreed, at no charge. Broken links, a form that does not submit, a layout that breaks on a supported device. It does not cover new pages, new features, content or design changes, or problems caused by you or someone else editing the site. That is what care plans are for.

After launch: hosting and care

Your site needs hosting to stay online, and you have two options. Pay Framer or Shopify directly for their ongoing subscription, at their current rates published on their own sites, and look after the domain, SSL, updates, backups, security and maintenance yourself. Or join one of my care plans, which are month to month with no lock in and cover hosting, domain, SSL, updates, backups, a monthly search visibility re-check and a change allowance from launch day. Care plans and their terms are at jyethetechguy.com/care-plans. Either way the site stays in your own account and you can switch between the two at any time.

Late payment

If an invoice is 7 days overdue I give you 5 business days written notice, then I may pause work and hold the launch until it is paid. Interest of 1% per month applies to overdue amounts and I may recover reasonable debt recovery costs. If you dispute a charge, raise it with me first and I will respond within 5 business days and refund anything not properly owed.

Cancelling

You can cancel at any time by email. Refunds work as set out under Your payment and my commitment. If you cancel once work has started, you pay for the work done and any third party costs committed up to that date, credited against what you have already paid, and any difference is refunded within 14 days. I can end the project if you breach these terms and do not fix it within 14 days of me asking. Either way, once everything is settled I hand over the work completed to that point.

You own it

You own everything you give me: your copy, images, logo and data. Once the project is paid in full you own the domain, the design and everything in it, and you can leave at any time and take it all with you. I keep ownership of my reusable components, animations, templates and methods, and you get a permanent licence to use them as part of your site. You cannot resell them or repackage them as a template. Until the project is paid in full, the site stays mine.

Third party stuff

Your site depends on Framer or Shopify, your domain registrar, Google and any integrations. Their costs are not in the project fee unless the quote says so. The accounts sit in your name so you stay in control. I am not responsible for their outages, price rises or feature changes, but I will tell you and suggest a way forward. Fonts, stock images and plugins have their own licences, which I will tell you about and which are yours to maintain after handover.

Browsers, devices and speed

I build and test on desktop, laptop, tablet and phone on current versions of major browsers, and speed test on all devices before launch. I do not guarantee the site looks identical on every device or old browser version, or any particular speed score after launch once you add content, apps or integrations.

Your content and compliance

You confirm you own or have permission to use everything you send me, and that publishing it will not infringe anyone’s rights or break any law. If it does, and I cop a claim because of it, you cover it. I build to good practice, but your own legal, privacy, cookie and industry compliance obligations are yours. If AI generated images or copy are used anywhere, I will tell you and you accept them by approving the site.

Portfolio and credit

I may show your website in my portfolio and marketing, excluding anything you tell me is confidential or not yet public. I may add a small credit and link in the footer, which I remove at no charge if you ask. Testimonials only with your written consent.

The legal bit

Nothing here removes your rights under the Australian Consumer Law or any law in your country that cannot be excluded. Beyond that, neither of us is liable for indirect loss and my total liability is capped at the fees you paid for the project. Neither of us is liable for delays caused by events outside our control. No website is completely secure, and while I build to good practice I cannot guarantee a site will never be compromised, so keep your own copy of anything important. We both keep each other’s private information confidential and I handle any personal information under the Privacy Act. If there is a problem, raise it with me in writing first and we will sort it out within 14 days. I operate from Australia, so these terms are governed by Australian law wherever you are, and any local taxes or currency costs are yours. I may update these terms, but the version you agreed to at payment is the one that applies to your project.
